Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using the CV Foundry mobile application (the "App") or any related services (collectively, the "Service"), you ("you" or "User") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Daniel Youssef, an individual based in Egypt with registered address at Tanta First District, Gharbia Governorate, Egypt ("we", "us", "our", or "CV Foundry").

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it.

You represent and warrant that:

• You are not barred from using the Service under any applicable law
• You are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

3. Definitions

• "Account" — your registered user account on the Service.
• "Content" — any text, data, images, files, or other material you submit, upload, or generate through the Service, including CVs and resume data.
• "Subscription" — a paid recurring plan granting access to Premium Features.
• "Premium Features" — features available only to active Subscribers (e.g., unlimited PDF downloads, watermark removal, all templates).
• "Templates" — the CV/resume layouts, designs, and styles we make available within the App.
• "App Stores" — Apple App Store, Google Play Store, and any other distribution platform.

4. Account Registration

To use most features of the Service, you must create an Account.

4.1 Authentication Methods

You may create an Account using:

• Email address with one-time password (OTP) verification
• Google Sign-In
• Apple Sign-In
• Any other authentication method we offer

4.2 Your Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your Account information
• Keep your authentication credentials confidential
• Notify us immediately of any unauthorized access to your Account
• Accept responsibility for all activities that occur under your Account

We reserve the right to suspend or terminate Accounts containing inaccurate, misleading, or fraudulent information.

4.3 One Account Per User

You may only maintain one Account at a time. Creating multiple Accounts to circumvent restrictions or abuse free tiers may result in termination.

5. Third-Party Authentication and Services

The Service integrates with third-party authentication providers (Google, Apple) and other third-party services (including Firebase Cloud Messaging for push notifications, analytics providers, and payment processors).

Your use of any third-party service is subject to that provider's own terms and privacy policy. We are not responsible for the practices of third-party services. We do not control, endorse, or assume responsibility for any third-party content, products, or services.

6. The Service

6.1 Description

CV Foundry provides tools to create, edit, customize, export, and manage professional CVs and resumes, including region-aware formatting, professional templates, and PDF export.

6.2 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or events beyond our control.

6.3 Service Modifications

We reserve the right to add, modify, suspend, or discontinue any feature, template, or part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

7. Subscriptions and In-App Purchases

7.1 Subscription Plans

We offer the following Subscription plans through Apple App Store and Google Play Store:

• 1-Month Plan — billed monthly
• 3-Month Plan — billed every three months
• 12-Month Plan — billed annually

Current pricing is displayed in the App and may vary by country, currency, applicable taxes, and exchange rates.

7.2 Billing and Auto-Renewal

By purchasing a Subscription, you authorize and agree to the following:

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage subscriptions and disable auto-renewal in your Apple ID Account Settings or Google Play Account Settings. You cannot disable auto-renewal from within the App.

7.3 Free Trials

If we offer a free trial:

• The trial converts automatically to a paid Subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends.
• Any unused portion of a free trial is forfeited upon purchase of a Subscription.
• You may only be eligible for one free trial per Apple ID or Google account.

7.4 Refunds

• All purchases are final. We do not directly issue refunds.
• Refund requests must be submitted to the relevant App Store and are subject to the App Store's refund policies:
  • Apple: https://reportaproblem.apple.com
  • Google Play: https://support.google.com/googleplay
• We have no control over App Store refund decisions.
• Where required by applicable consumer protection law (including the EU Consumer Rights Directive), statutory withdrawal rights apply and override this section.

7.5 Price Changes

We may change Subscription prices from time to time. Price changes will:

• Take effect at the start of the next billing period following the change
• Be communicated to you in advance via in-App notification, email, or App Store mechanism
• Give you the opportunity to cancel before the new price applies

If you do not agree to a price change, your sole remedy is to cancel before the change takes effect.

7.6 Taxes

Prices may exclude applicable taxes (VAT, GST, sales tax). The App Store will collect and remit applicable taxes on our behalf where required.

7.7 Cancellation Effects

Upon cancellation:

• You retain access to Premium Features until the end of your current paid period
• You will not receive a refund for the unused portion of the current period (subject to Section 7.4)
• Your Subscription will not renew

8. Your Content

8.1 Ownership

You retain all rights, title, and interest in the Content you create, including your CVs and resume data. We claim no ownership over your Content.

8.2 License to Us

By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, format, and display your Content solely for the purpose of operating and providing the Service to you. This license terminates when you delete the Content or your Account, except where retention is required by law or for legitimate business purposes (e.g., backup, fraud prevention).

8.3 Your Representations

You represent and warrant that:

• You own or have all necessary rights to your Content
• Your Content does not infringe any third party's intellectual property, privacy, or other rights
• Your Content does not violate any law or these Terms
• All information you include (employment history, education, credentials) is accurate to the best of your knowledge

8.4 Backup

You are solely responsible for maintaining backups of your Content. We make reasonable efforts but do not guarantee that Content will not be lost, corrupted, or deleted.

9. Intellectual Property

9.1 Our Property

The Service, including the App, Templates, designs, source code, trademarks, logos, graphics, user interface, and all related intellectual property, is owned by us or our licensors and is protected by copyright, trademark, and other laws.

9.2 License to You

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Install and use one copy of the App on devices you own or control
• Use Templates solely to create CVs for your personal job-seeking purposes
• Export CVs you create as PDF files for personal use

9.3 Restrictions

You may not:

• Resell, redistribute, sublicense, or commercially exploit Templates
• Copy, modify, or create derivative works of the App or Templates
• Reverse engineer, decompile, or disassemble the App (except as expressly permitted by law)
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Service to build a competing product
• Use automated means (bots, scrapers) to access the Service
• Use Templates as part of a service that generates CVs for third parties
• Use our trademarks or branding without prior written permission

10. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right
• Submit false, misleading, defamatory, or fraudulent information
• Impersonate any person or entity
• Upload viruses, malware, or any harmful code
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Harass, abuse, or harm another person
• Use the Service to misrepresent professional qualifications, certifications, or employment history in a way intended to defraud
• Engage in any activity that could damage, disable, or impair the Service

Violation of this section may result in immediate Account suspension or termination, with no refund.

11. Push Notifications

By enabling notifications, you consent to receive push notifications from us through Firebase Cloud Messaging (FCM) and platform notification services. You may disable notifications at any time through your device settings.

12. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, store, and share your information. By using the Service, you acknowledge and consent to such practices.

13. Apple App Store Additional Terms

These Terms apply to your use of the App downloaded from the Apple App Store. You and we acknowledge that:

• Relationship. These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
• Scope of License. Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
• Maintenance and Support. We, not Apple, are solely responsible for providing maintenance and support for the App.
• Warranty. We, not Apple, are solely responsible for any product warranties, whether express or implied by law, that are not effectively disclaimed. In the event of any failure to conform to applicable warranty, you may notify Apple, and Apple will refund the App's purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Product Claims. We, not Apple, are responsible for addressing your or any third party's claims relating to the App, including product liability claims, regulatory claims, or consumer protection claims.
• Intellectual Property. In the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, are solely responsible for investigation, defense, settlement, and discharge.
• Legal Compliance. You represent that you are not located in a U.S.-embargoed country and not on any U.S. Government prohibited or restricted parties list.
• Third-Party Beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

14. Google Play Additional Terms

Where you downloaded the App from Google Play, you acknowledge that these Terms are between you and us, not Google. Google is not responsible for the App, its content, support, or any claims arising from your use. Your use of the App must comply with the Google Play Terms of Service.

15. Disclaimers

15.1 As-Is Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including without limitation:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses
• Warranties regarding the accuracy, reliability, or completeness of any content

15.2 No Career or Employment Guarantees

We make no representations or warranties regarding your job search outcomes. The Service is a tool to assist you in creating CVs. We do not guarantee:

• That your CV will pass any Applicant Tracking System (ATS)
• That you will be hired, interviewed, or shortlisted for any position
• The accuracy of any regional formatting recommendations
• That Templates comply with employer-specific requirements

Hiring decisions are made by employers based on many factors outside our control.

15.3 Statutory Rights

Some jurisdictions do not allow the exclusion of certain warranties. To the extent applicable law does not permit such exclusion, the disclaimers above apply only to the maximum extent permitted by law, and your statutory rights remain unaffected.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation: loss of profits, revenue, data, goodwill, employment opportunities, or career outcomes, even if we were advised of the possibility of such damages.
• Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (USD $50.00).
• This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
• Nothing in this section limits liability that cannot be excluded under applicable law (e.g., for fraud, willful misconduct, gross negligence, death, or personal injury caused by negligence).

17. Indemnification

You agree to defend, indemnify, and hold harmless CV Foundry, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Service
• Your Content
• Your violation of these Terms
• Your violation of any third-party right (including intellectual property, privacy, or publicity rights)
• Your violation of any applicable law

We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with our defense.

18. Account Termination

18.1 Termination by You

You may terminate your Account at any time by using the in-App "Delete Account" function. Upon deletion:

• Your Content will be permanently removed from our active systems within 30 days
• Backups may persist for up to 90 days before being purged
• Active Subscriptions will continue until their current billing period ends (cancellation must be done through the App Store separately)
• Information we are required to retain by law (e.g., transaction records for tax/audit) will be retained for the required period

18.2 Termination by Us

We may suspend or terminate your Account or access to the Service at any time, with or without notice, if:

• You violate these Terms
• Your use poses a security or legal risk
• We are required to do so by law
• We discontinue the Service

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including IP, disclaimers, limitations of liability, indemnification, and governing law) shall survive.

19. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top
• Notify you via in-App notification, email, or other reasonable means at least 30 days before changes take effect (for material changes)

Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Service and may delete your Account.

20. Governing Law and Dispute Resolution

20.1 Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict of laws principles.

20.2 Jurisdiction

You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of Tanta, Egypt, and you consent to the personal jurisdiction of such courts.

20.3 Informal Resolution

Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at contact@cvfoundry.app. We will attempt to resolve disputes in good faith within 60 days.

20.4 Consumer Rights

Nothing in this section limits any mandatory consumer rights granted to you under applicable local law, including the right to bring proceedings in the courts of your country of residence (where applicable).

21. General Provisions

21.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the Service.

21.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

21.3 No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

21.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

21.5 Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, government action, labor disputes, or internet/infrastructure failures.

21.6 No Agency

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and us.

21.7 Notices

Notices to you may be provided via in-App message, email, or via the App Store. Notices to us must be sent to contact@cvfoundry.app with a copy to First District, Gharbia Governorate, Egypt.

21.8 Language

These Terms are provided in English. Where translations are offered for convenience, the English version controls in case of any conflict.
